MKGRSTUDIO Ltd terms and conditions

These Terms govern use of the MKGRSTUDIO website, apps, streams and services. By using the website or commissioning a service, you agree to these Terms.

1. Agreement and services

What these Terms cover

If you do not agree to these Terms, please do not use the website or services. MKGRSTUDIO Ltd provides hidden-talent development in music, podcasting, internet radio, worship facilitation and related media production, training and support.

The scope, deliverables, fees, timetable and project-specific conditions for commissioned work will be confirmed in a written proposal, quotation or service agreement before work begins.

2. Client obligations

Information, permissions and cooperation

  • Provide accurate information and reasonable cooperation needed to deliver the agreed work.
  • Obtain required permissions for locations, performers, contributors and third-party materials.
  • Ensure agreed personnel, facilities and approvals are available when needed.
  • Pay agreed fees in accordance with the quotation, contract and invoice.
  • Approve in writing any requested variation or additional service outside the agreed scope.

3. Fees and payment

Charges follow the written agreement

Fees, invoice dates and payment periods are those stated in the applicable quotation, service agreement or invoice. Additional or varied work requires written approval and may be charged separately. MKGRSTUDIO Ltd may suspend or cease services where payment obligations are not met, subject to the applicable agreement and law.

4. Intellectual property

Ownership and the licence to use delivered work

Unless a written service agreement expressly says otherwise, content created by MKGRSTUDIO Ltd—including video, audio, photography, podcasts, training materials, scripts, designs, graphics, branding, software, radio streams and website code—remains the property of MKGRSTUDIO Ltd or its licensors.

After full payment, the client receives a non-exclusive, non-transferable licence to use delivered content for the promotional, educational, community or other purposes stated in the applicable agreement. Resale, sublicensing, commercial distribution, assignment to a third party or use for a materially new purpose requires written permission and may require a separate licence or fee.

5. Third-party material

Rights, releases and credits

  • You must obtain the necessary rights, releases, permissions and licences for talent, locations, music, imagery and other material you provide or request.
  • By supplying material, you confirm that you have authority to use it and grant MKGRSTUDIO Ltd permission to incorporate it into the agreed deliverables.
  • Relevant authors and contributors may retain moral rights, including attribution rights, and agreed credits must not be removed or obscured without written approval.
  • You are responsible for claims arising from permissions you were required to obtain but did not obtain, subject to the applicable agreement and law.

6. Responsible use

Restrictions across the website and services

  • Do not misuse the service, attempt unauthorised access or disrupt the stream.
  • Do not submit unlawful, abusive, defamatory, discriminatory or rights-infringing material.
  • Do not copy, modify, reverse-engineer, resell or redistribute programmes, music, artwork, software, recordings or other deliverables outside the agreed licence.
  • Do not rely on faith, wellbeing, legal, financial or community discussions as a substitute for qualified individual advice.
  • MKGRSTUDIO Ltd may moderate, edit, decline or remove submissions and may change schedules or availability.

7. Confidentiality and data

Non-public information and personal data

Each party will protect non-public information received in connection with a service and will not disclose it without permission except where disclosure is required by law or is necessary to fulfil the agreement. Personal data is processed in accordance with the Privacy Policy and applicable data-protection law.

8. Liability and availability

Reasonable skill and care

MKGRSTUDIO Ltd will perform commissioned services with reasonable skill and care. Website, streaming and digital availability may be affected by maintenance, networks, third-party platforms and events outside reasonable control.

Except where liability cannot lawfully be excluded or limited, the total liability arising from a commissioned service is limited to the fees paid for the service giving rise to the claim, and MKGRSTUDIO Ltd is not liable for indirect or consequential loss, including loss of profit, data or goodwill.

9. Suspension, termination and changes

When services or these Terms change

A service may be suspended or terminated in accordance with the applicable agreement, including for non-payment, misuse of content or another material breach. On termination, use outside the licence granted must stop and relevant materials must be returned or destroyed where the agreement requires it.

MKGRSTUDIO Ltd may update these Terms. Revised Terms will be published here and apply from the stated revision date, subject to any existing written service agreement.

10. Governing law

England and Wales

These Terms are governed by the laws of England and Wales. Disputes arising from them are subject to the jurisdiction of the courts of England and Wales. If one provision is found invalid or unenforceable, the remaining provisions continue in effect. These Terms and the applicable written quotation or service agreement form the agreement concerning the relevant services.
